CO2 Coalition Seeks to Defend Repeal of EPA Rule

FAIRFAX, Va. – The CO2 Coalition is requesting to join a federal D.C. Court of Appeals case to support the EPA’s repeal of a 2009 rule that classified carbon dioxide emissions from vehicles as a dangerous pollutant.

The Coalition’s March20th motion to intervene is a response to environmental organizations and several states that filed legal challenges to the EPA repeal, which was announced in February. The agency had concluded that it did not have authority under the federal Clean Air Act to regulate carbon dioxide.

“The basis of the wrongheaded Endangerment Finding put ideology ahead of science,” said Gregory Wrightstone, Executive Director of the CO2 Coalition, a nonprofit organization of more than 200 scientists and researchers. “The rule has been an impediment to economic growth, a cause of rising energy costs and a destroyer of many thousands of jobs at power plants, coal mines and manufacturing facilities.

“Since its 2009 enactment, the Endangerment Finding’s scientific underpinnings have been found to be even weaker than previously believed and contradicted by empirical data, peer-reviewed studies and research.”

Founded in 2015, the CO2 Coalition is a nonprofit organization with a mission to advance the public understanding of carbon dioxide’s essential role in sustaining plant life, agriculture and the global ecosystem.

The Coalition filing includes statements of members engaged in activities like farming and forestry. They note the benefits of higher levels of atmospheric CO2 for plants and list negative effects of the Endangerment Finding, including higher costs for equipment and of doing business in general.

“EPA’s repeal of the Endangerment Finding is a welcome action based on sound legal reasoning,” said Executive Director Wrightstone. “The CO2 Coalition will present scientific facts and data demonstrating the fallacy underlying the rule – that carbon dioxide is a toxin. The planet is benefiting from rising CO2 levels and will continue to do so. There is no climate crisis.”

Attorneys Andrew Grossman, Mark Delaquil and Benjamin Janacek of Baker and Hostetler law firm filed the intervention on behalf of the CO2 Coalition.
